The following agreement is between the Seller, Humbly Hungry Kennels, and (Name of the buyer as expected on registration certificate), hereafter referred to as “Purchaser” for the sale and purchase of one purebred dog of the French Bulldog breed of which five hundred dollars is a non-refundable deposit from the total sales price.
2. PURCHASE AND TRANSFER OF OWNERSHIP
The Seller agrees to sell, and the Buyer agrees to purchase, the puppy described in this Agreement for the purchase price stated above.
Upon receipt of the full purchase price and completion of the sale, ownership and ordinary responsibilities for the puppy transfer to the Buyer, subject to the terms of this Agreement and applicable law.
The $500 deposit reserves the selected puppy and will be credited toward the total purchase price. The deposit is nonrefundable if the Buyer voluntarily cancels the purchase, except where a refund is required by applicable law or another provision of this Agreement.
This Agreement constitutes the entire agreement between the parties concerning this sale, except for any written addenda signed by both parties.
3. INTENDED USE AND RESPONSIBLE OWNERSHIP
The puppy is sold primarily as a family companion. The Buyer agrees to provide appropriate housing, nutrition, exercise, socialization, supervision, and veterinary care throughout the dog's life.
The Buyer agrees not to use the dog for unlawful activities, animal fighting, neglectful purposes, or activities inappropriate for the dog's health, temperament, or physical condition.
The Buyer acknowledges that French Bulldogs are a brachycephalic breed, meaning they have shortened facial structures that may predispose them to breathing difficulties, heat intolerance, and other breed-associated health concerns.
The Buyer agrees to take reasonable precautions to protect the puppy from overheating, excessive exertion, unsafe jumping, traumatic injury, and other preventable risks.
4. SELLER'S HEALTH REPRESENTATIONS
The Seller represents that, to the Seller's knowledge, the puppy is in reasonably good health and has no known undisclosed illness at the time of delivery.
The Seller will provide available veterinary and vaccination records, deworming records, and other relevant health documentation in the Seller's possession.
The Seller does not represent that the puppy is guaranteed to remain free of all illness, congenital conditions, hereditary conditions, or future medical problems.
No living animal can be guaranteed to remain free of disease or injury throughout its lifetime. This Agreement provides only the specific limited health protection described in Section 6.
Parental health testing: Any representation concerning OFA certifications, hip clearances, cardiac examinations, or other health screenings of the sire or dam will be made only to the extent supported by actual records. The Seller will not represent that a parent has a particular certification unless that certification has been verified.
5. REQUIRED VETERINARY EXAMINATION WITHIN 72 HOURS
The Buyer agrees to have the puppy examined by a licensed veterinarian of the Buyer's choice within 72 hours of physical delivery, excluding no time unless required by applicable law or an emergency makes timely examination impossible.
The examination should include a general physical assessment, heart and respiratory evaluation, orthopedic and spinal assessment appropriate to the puppy's age, and any additional testing the examining veterinarian considers medically appropriate.
The Buyer must provide proof of the examination to the Seller upon reasonable request.
If the veterinarian identifies a suspected significant congenital condition, hereditary condition, or other material health concern, the Buyer agrees to notify the Seller promptly and provide the relevant written veterinary findings.
If the examination cannot be completed within 72 hours because of an emergency or circumstances beyond the Buyer's reasonable control, the Buyer must notify the Seller as soon as reasonably possible and arrange an examination at the earliest medically appropriate opportunity.
Failure to comply with this requirement may affect eligibility for the Seller's voluntary contractual guarantee to the extent permitted by law. It will not eliminate any nonwaivable statutory consumer rights.
6. SIX-MONTH LIMITED CONGENITAL AND HEREDITARY HEALTH GUARANTEE
Humbly Hungry Kennels LLC provides a limited health guarantee for six (6) months from the date of delivery against qualifying congenital or hereditary conditions that meet all the requirements in this section.
To qualify, a condition must:
Be diagnosed in writing by a licensed veterinarian as congenital or hereditary, or be supported by appropriate veterinary diagnostic evidence establishing that it is congenital or hereditary.
Be a significant medical condition that materially affects the puppy's health, normal function, or quality of life, rather than a minor variation or cosmetic characteristic.
Be reported to the Seller promptly after discovery, with veterinary documentation sufficient to evaluate the claim.
Not be primarily attributable to an accident, injury, neglect, improper care, an unrelated illness, or another exclusion in this Agreement.
Where signs of a potentially qualifying condition appear during the six-month period but a definitive diagnosis reasonably requires additional testing or specialist evaluation, the Buyer must document and report those signs during the guarantee period. The parties will evaluate the claim using the available veterinary evidence and applicable law.
A. Hip Dysplasia and Orthopedic Conditions
This guarantee may cover a significant congenital or hereditary orthopedic condition, including hip dysplasia, when the condition satisfies the requirements above and is established through appropriate veterinary examination and diagnostic testing.
A diagnosis of hip dysplasia alone does not automatically establish that the condition is severe, disabling, or covered. The veterinarian's findings regarding severity, functional impairment, and recommended treatment will be considered.
The Seller does not guarantee a particular hip rating or future orthopedic outcome unless expressly stated in a separate written agreement.
B. Heart Conditions
This guarantee may cover a significant congenital or hereditary heart defect that materially affects the puppy's health or normal function and is confirmed through appropriate veterinary evaluation.
Routine heart-rate variations, temporary illness, acquired heart disease, and conditions unrelated to a congenital or hereditary defect are not automatically covered.
C. Spinal and Neurological Conditions
This guarantee may cover a significant congenital or hereditary spinal or neurological condition, including a qualifying congenital vertebral abnormality, when supported by appropriate veterinary diagnostic evidence and when the other requirements of this section are met.
Intervertebral disc disease, spinal injury, paralysis, or other spinal conditions are not automatically presumed hereditary or congenital. Their cause, timing, and available diagnostic evidence must be considered individually.
D. Nasal, Airway, and Breathing Conditions
This guarantee may cover a significant congenital or hereditary airway abnormality that materially impairs normal breathing and meets the requirements of this section.
French Bulldogs may naturally have shortened muzzles and breed-associated respiratory characteristics. The existence of a shortened muzzle, ordinary breed appearance, or a minor anatomical variation does not by itself establish a qualifying defect.
A veterinarian's diagnosis of clinically significant brachycephalic obstructive airway syndrome (BOAS) or another congenital airway abnormality will be evaluated according to its severity, functional impact, diagnostic evidence, and the other requirements of this Agreement.
The Seller does not guarantee that the puppy will never snore, snort, make breathing noises, or develop an airway problem. However, the breed's characteristics will not be used to dismiss a genuine qualifying congenital condition.
7. HEALTH CLAIM PROCEDURE AND REMEDIES
If the Buyer believes the puppy has a condition covered by Section 6, the Buyer agrees to:
Notify Humbly Hungry Kennels LLC in writing promptly after receiving the suspected diagnosis.
Provide the veterinary examination findings, diagnostic reports, test results, relevant medical records, and an itemized estimate of recommended treatment when reasonably available.
Allow the Seller a reasonable opportunity to review the documentation and, where medically appropriate, seek an independent veterinary opinion.
Cooperate in good faith with reasonable requests for records or clarification.
The Buyer is responsible for arranging and paying for veterinary examinations, diagnostic testing, and treatment unless applicable law requires otherwise or the parties agree in writing to another arrangement.
The Buyer must not delay emergency treatment to obtain the Seller's approval. The puppy's health and welfare must take priority.
If a claim is confirmed as qualifying under this Agreement, the remedy will be determined in accordance with applicable law and any applicable mandatory consumer protections. Subject to those requirements, the Seller may offer a replacement puppy of comparable value, a refund of the purchase price, or another mutually agreed written resolution.
A replacement is subject to puppy availability and must not be used to delay or defeat a remedy required by law.
This limited guarantee does not automatically cover veterinary bills, medication, transportation, boarding, lost income, or other incidental expenses unless required by law or expressly agreed to in writing.
No provision in this Agreement limits a Buyer's nonwaivable legal rights.
8. EXCLUSIONS FROM THE VOLUNTARY HEALTH GUARANTEE
To the extent permitted by law, the voluntary six-month guarantee does not cover conditions primarily caused by:
Accidental injury, trauma, falls, or other physical damage occurring after delivery.
Neglect, abuse, inadequate nutrition, dehydration, or failure to obtain necessary veterinary care.
Failure to follow reasonable veterinary instructions or medically appropriate treatment.
Obesity, inappropriate exercise, repetitive high-impact activity, or preventable overheating.
Infectious disease or parasites acquired after delivery, except where the condition is otherwise covered by applicable law or a separate written guarantee.
Allergies, skin conditions, ear infections, gastrointestinal problems, or other illnesses that have not been established to qualify under Section 6.
Cosmetic characteristics, minor conformational variations, or conditions that do not materially affect health or function.
Elective procedures, routine preventive care, vaccinations, and ordinary expenses associated with raising the puppy.
These exclusions do not apply when doing so would eliminate a mandatory legal remedy or when the evidence establishes that an otherwise covered congenital or hereditary condition is the actual cause of the problem.
9. BUYER'S ONGOING CARE OBLIGATIONS
The Buyer agrees to:
Maintain regular veterinary examinations and provide vaccinations and preventive care as recommended by a licensed veterinarian.
Provide appropriate food, clean water, safe shelter, humane treatment, and suitable exercise.
Keep the puppy at a healthy weight and monitor breathing, mobility, and other signs of illness.
Avoid excessive heat and strenuous activity that could place a French Bulldog at risk.
Seek prompt veterinary attention for breathing distress, collapse, severe pain, inability to walk, or other urgent medical concerns.
All ordinary veterinary costs and expenses incurred after delivery are the Buyer's responsibility, except as otherwise required by applicable law or expressly agreed in writing.
10. RETURN-TO-BREEDER POLICY
If the Buyer becomes unable or unwilling to keep or properly care for the dog at any point during its lifetime, the Buyer agrees to contact Humbly Hungry Kennels LLC before transferring ownership or arranging another placement.
The Seller must be given the opportunity to discuss a safe return or responsible rehoming arrangement. The Buyer shall not abandon the dog or transfer it to a shelter, reseller, research facility, or another party for resale without first contacting the Seller, except where immediate action is necessary to protect the dog's welfare or applicable law requires otherwise.
Any return, refund, or transfer of ownership will be documented in writing. A return under this section does not automatically entitle the Buyer to a refund unless required by this Agreement or applicable law.
11. AKC REGISTRATION AND PEDIGREE DOCUMENTATION
The Seller represents that the puppy is eligible for American Kennel Club registration only if the applicable registration requirements are satisfied.
The Seller agrees to provide the applicable registration documents and complete the required transfer or registration steps in accordance with the agreed sale terms and AKC rules.
The Seller may reserve or use the kennel name in the puppy's registered name if this requirement is disclosed and agreed upon in writing before the sale.
The Buyer understands that AKC registration verifies registration and pedigree information under AKC rules; it is not a certification that the dog is free from genetic disease or future health problems.
12. ENTIRE AGREEMENT AND ACKNOWLEDGMENT
This Agreement contains the parties' understanding regarding the sale, ownership responsibilities, and limited health guarantee for the puppy described above.
Any amendment or additional health promise must be in writing and signed by both parties. If a provision is determined to be unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
The Buyer acknowledges having had an opportunity to review this Agreement, ask questions, and receive a copy before or at the time of sale.
Nothing in this Agreement is intended to waive consumer protections or remedies that cannot legally be waived.
